Terms and Conditions<\/b><\/b><\/h1>\n

1. Agreement to Terms<\/b><\/b><\/h2>\n

By accessing or using the Moley website and purchasing our products, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website. These Terms apply alongside, and do not limit, any mandatory rights available to you under EU and EEA consumer protection law, including the law of your country of residence.<\/p>\n

2. Products and Pricing<\/b><\/b><\/h2>\n

All products are subject to availability. We reserve the right to discontinue any product at any time. Prices are displayed in EUR and include VAT where applicable. We reserve the right to change prices without notice, but any price changes will not affect orders already placed.<\/p>\n

3. Orders and Payment<\/b><\/b><\/h2>\n

By placing an order, you are making an offer to purchase products.<\/p>\n

  • We reserve the right to refuse or cancel any order for any reason.<\/li>\n
  • Payment must be received in full before order dispatch.<\/li>\n
  • We accept major credit cards and other payment methods as displayed at checkout.<\/li>\n<\/ul>\n

    4. Shipping and Delivery<\/b><\/b><\/h2>\n

    We currently ship to Finland, Sweden, and Norway.<\/p>\n

      \n
    • Delivery times are estimates and not guaranteed.<\/li>\n
    • Risk of loss passes to you upon delivery to the carrier.<\/li>\n
    • We are not responsible for delays caused by customs or shipping carriers.<\/li>\n
    • If a parcel is not collected from a parcel locker and is returned to us, we can resend it. Additional shipping charges may apply.<\/li>\n<\/ul>\n

      5. Right of Withdrawal (EU\/EEA Consumers)<\/b><\/b><\/h2>\n

      If you are a consumer residing in the EU or EEA, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, under the EU Consumer Rights Directive (2011\/83\/EU) and equivalent national legislation.<\/p>\n

      To exercise your right of withdrawal:<\/p>\n

        \n
      • Notify us within 14 days of delivery by emailing hello@getmoley.com with your order number and a clear statement that you wish to withdraw.<\/li>\n
      • Return the goods to us without undue delay and in any event within 14 days of notifying us, unless we offer to collect them.<\/li>\n
      • We will refund the price paid, including the standard delivery cost, within 14 days of receiving the returned goods or evidence that you have sent them back.<\/li>\n<\/ul>\n

        You are responsible for the direct cost of returning goods, unless we have agreed to cover it (as described in our extended return policy below) or failed to inform you of this cost. This right of withdrawal does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons if they have been unsealed after delivery.<\/p>\n

        For hygiene reasons, opened or used personal care items can only be returned if they arrived defective. To initiate a return:<\/p>\n

        • Contact us at hello@getmoley.com with your order number and reason for return.<\/li>\n
        • We will provide a prepaid return label within 24 hours.<\/li>\n
        • Original shipping costs are non-refundable for change-of-mind returns made after the 14-day statutory withdrawal period described above.<\/li>\n
        • Refunds are processed within 5-7 business days of receiving the return.<\/li>\n<\/ul>\n

          7. Product Warranty<\/b><\/b><\/h2>\n

          Our products come with a 1-year commercial warranty against manufacturing defects. This commercial warranty does not cover:<\/p>\n

            \n
          • Damage caused by water exposure beyond the product’s rated waterproof specification<\/li>\n
          • Modifications or repairs by unauthorized parties<\/li>\n
          • Normal wear and tear<\/li>\n
          • Damage caused by misuse or improper installation<\/li>\n<\/ul>\n

            This commercial warranty is in addition to, and does not replace or limit, your statutory legal guarantee of conformity as an EU or EEA consumer. Under EU law (Directive (EU) 2019\/771) and its national implementations, you are entitled to a minimum two-year legal guarantee from delivery, during which we remain liable, free of charge, for any lack of conformity that existed at the time of delivery, through repair, replacement, price reduction, or termination of the contract, as applicable.<\/p>\n

            8. Intellectual Property<\/b><\/b><\/h2>\n

            All content on this website, including text, images, logos, and designs, is the property of Moley O\u00dc and protected by copyright laws. You may not use, reproduce, or distribute our content without written permission.<\/p>\n

            9. User Accounts<\/b><\/b><\/h2>\n

            If you create an account, you are responsible for:<\/p>\n

              \n
            • Providing accurate and up-to-date account information<\/li>\n
            • Maintaining the confidentiality of your login credentials<\/li>\n
            • Notifying us immediately of any unauthorized use<\/li>\n
            • All activities that occur under your account<\/li>\n<\/ul>\n

              10. Limitation of Liability<\/b><\/b><\/h2>\n

              To the maximum extent permitted by law, Moley shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website. Our total liability shall not exceed the amount you paid for the product in question. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer under EU or national consumer protection law, or liability for death or personal injury caused by negligence.<\/p>\n

              11. Indemnification<\/b><\/b><\/h2>\n

              You agree to indemnify and hold Moley O\u00dc harmless from any claims, damages, or expenses arising from your violation of these terms or misuse of our products.<\/p>\n

              12. Governing Law and Jurisdiction<\/b><\/b><\/h2>\n

              These Terms are governed by the laws of Estonia. If you are a consumer resident in the EU or EEA, this choice of law does not deprive you of the protection of any mandatory consumer protection provisions of the law of your country of residence. Any disputes shall be resolved in the courts of Estonia, unless applicable law grants you the right to bring proceedings in the courts of your own country of residence, in which case that right is preserved.<\/p>\n

              13. Dispute Resolution<\/b><\/b><\/h2>\n

              If you are not satisfied with how we have handled a complaint, you may contact the consumer protection or dispute resolution authority in your country of residence. The European Commission’s Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.<\/p>\n

              14. Changes to Terms<\/b><\/b><\/h2>\n

              We reserve the right to update these terms at any time. Continued use of the website after changes constitutes acceptance of the new terms.<\/p>\n

              15. Severability<\/b><\/b><\/h2>\n

              If any provision of these terms is found to be unenforceable, the remaining provisions will continue in effect.<\/p>\n

              16. Privacy<\/b><\/b><\/h2>\n

              Your personal data is processed in accordance with our Privacy Policy and applicable data protection law, including the EU General Data Protection Regulation (GDPR). See our Privacy Policy at getmoley.com\/privacy-policy for details.<\/p>\n
